Access to Information (PAIA)

This page explains how to access information from Ensemble Trading 460 (Pty) Ltd t/a The Learning Organisation under the Promotion of Access to Information Act, 2000 (PAIA). It also links to our Section 51 PAIA Manual and the Information Regulator’s Guide.

What you can request

As a private body, we consider requests for existing recorded information that is required for the exercise or protection of a right (PAIA section 50). We don’t create new records or opinions for requesters.

Some items are already public (e.g., our privacy policy and terms) and are linked on our website. All other records require a formal PAIA request.

How to make a PAIA request (step-by-step)

1.  Complete Form 2 (prescribed by PAIA).

2.  Explain the right you seek to exercise or protect and why the record is required.

3.  Describe the record(s) clearly and tell us how you prefer to receive access (e.g., copy by e-mail).

4.  Attach proof of identity. If you act for someone else, include proof of authority.

5.  Send your request to: paia@tlo.co.za or deliver to our head office (address below).

We aim to acknowledge valid requests within 2 business days.

Fees

  • For non-personal records, a request fee is payable before processing.

  • Reproduction and postage/courier fees may apply.

  • A deposit may be requested for large/complex searches.

  • For personal information requests, only reproduction/postage fees may apply.
    We apply the fee schedule in the PAIA Regulations (Annexure B) as amended from time to time.

Timelines and extensions

We decide within 30 calendar days of receiving a valid request. We may extend once for up to a further 30 days (e.g., large volume, off-site searches, third-party consultations). We’ll notify you with reasons if we extend.

Possible outcomes

  • Access granted (full or partial, with necessary redactions).

  • Access refused on lawful grounds (for example: protection of personal information; third-party or our own confidential commercial information; legal privilege; safety/law-enforcement; research). Where only part of a record is protected, we provide partial access.

Help if you cannot complete the form

If you cannot complete Form 2 because of illiteracy or a disability, we will provide reasonable assistance to make the request (PAIA s53(2)).

POPIA (privacy) rights

For personal information, you may request access, correction or deletion, object to certain processing (including direct marketing), and lodge a complaint with the Information Regulator. See the PAIA Manual for details.

Regulators and statutory requests

SARS, SETAs/QCTO and other authorities should use their statutory channels and directives rather than PAIA where applicable.
